Should I research the EB-5 Regional Center or the EB-5 Project?

The main concern for most investors on the early stage of the EB-5 Program process is to make a right investment choice. This choice will directly influence foreign investor’s ability to obtain green card and get their money back.

When making their choice investors rely on different factors. Most of them are choosing the Regional Center based on its success record without considering particular project it offers.

It is vital to understand here that the EB-5 Regional Center and the EB-5 Project are two independent entities. And it is not the best decision to make your choice based entirely on the Regional Center’s reputation. Moreover, the success of the EB-5 project that particular Regional Center has represented in the past does not necessarily guarantee the next EB-5 projects to have the same success.

It is more important to concentrate on the present and future of the EB-5 Regional Center and the projects that this Regional Center is now promoting. For example, in order to have EB-5 conditional green card approved and have conditions removed after 2 years investor should analyze Project’s documentation and see if it is able to create the amount of jobs necessary according to EB-5 visa requirements. There are many other requirements like this that project has to meet.

Choosing an EB-5 Project? Make sure you do your research!

We have stressed the importance of doing research and due diligence on EB-5 Regional Center’s and their active Projects in many of our blogs. 

Why is doing your research on a Regional Center and its project so important? Foreigners from different countries of the world are investing into the EB-5 Program in order to obtain their permanent U.S. Residency. Congress intended the program to create jobs for Americans and to encourage foreign investment of capital in the United States. The most important condition the Regional Centers need to meet in order for the foreign investors to receive their permanent U.S. Residency is to create 10 jobs per family that has invested in the Regional Center Project. If these 10 jobs per family are not created, the investors will not receive their permanent U.S. Residency and they will have to go back to their home country.

This is a BIG risk for foreign investor – they have to rely 100% on the Regional Center Project to create the jobs necessary.

There are risky projects being offered and presented as the safest in EB-5 and if you don’t do your research you may fall into their traps. For instance, an approved EB-5 Regional Center announced their three phase project in 2003 and as of today it still has not completed any of the three phases. Several EB-5 investors have made their $500,000 investment and are under the impression that everything is moving smoothly with this project. There are statements in the press stating that the project’s first phase is short of financing and this is forcing the developer in looking for a cheaper and quicker construction method which requires fewer construction workers. It is also believed that the second phase of the project has been delayed and as of today plans for this phase have not been finalized. These results will affect each foreign investor who has invested in this project tremendously, the approval of their I-526 and I-829 is at risk and they can possibly loose there investment and will not receive their Permanent U.S. Residency.

It is critical to look at how reasonable it will be for the EB-5 Regional Center and the EB-5 Project to provide successful answers to your questions when considering investment into an approved EB-5 Project, while at the same time looking beyond the flashy marketing materials and not simply taking the advice of the “salesman” who may be receiving a large commission for you investing into the EB5 Project. 

There are many factors that need to be taken into account when considering investment into an EB-5 Regional Center and EB-5Project. The Latest Statistics for the EB-5 Visa (June 2011 Stakeholder Meeting)

According to the report that was released by USCIS after the EB-5 Immigrant Investor Program Stakeholder Meeting on June, 30 there are 147 approved EB-5 Regional Centers (RCs), operating in 39 states, including the District of Columbia and Guam.

Throughout the last year (2010) there were a total of 1,885 EB-5 visas issued. USCIS estimates that first and second quarters of 2011 result in 2,129 EB-5 visas issuance.

USCIS report states that more than 90% of the individual Form I-526 petitions filed each year are filed by Alien Investors who are investing in RC-affiliated commercial enterprises as compared to a “Direct EB-5 Project”.

Despite the fact that there is currently over 140 approved Regional Centers, not all of them have active EB-5 projects and out of those that have active projects not all are what would be considered “secure” and some can be considered “speculative”.
