Choosing an EB-5 Project? Make sure you do your research!
Why is doing your research on a Regional Center and its project so important? Foreigners from different countries of the world are investing into the EB-5 Program in order to obtain their permanent U.S. Residency. Congress intended the program to create jobs for Americans and to encourage foreign investment of capital in the United States. The most important condition the Regional Centers need to meet in order for the foreign investors to receive their permanent U.S. Residency is to create 10 jobs per family that has invested in the Regional Center Project. If these 10 jobs per family are not created, the investors will not receive their permanent U.S. Residency and they will have to go back to their home country.
This is a BIG risk for foreign investor – they have to rely 100% on the Regional Center Project to create the jobs necessary.
There are risky projects being offered and presented as the safest in EB-5 and if you don’t do your research you may fall into their traps. For instance, an approved EB-5 Regional Center announced their three phase project in 2003 and as of today it still has not completed any of the three phases. Several EB-5 investors have made their $500,000 investment and are under the impression that everything is moving smoothly with this project. There are statements in the press stating that the project’s first phase is short of financing and this is forcing the developer in looking for a cheaper and quicker construction method which requires fewer construction workers. It is also believed that the second phase of the project has been delayed and as of today plans for this phase have not been finalized. These results will affect each foreign investor who has invested in this project tremendously, the approval of their I-526 and I-829 is at risk and they can possibly loose there investment and will not receive their Permanent U.S. Residency.
It is critical to look at how reasonable it will be for the EB-5 Regional Center and the EB-5 Project to provide successful answers to your questions when considering investment into an approved EB-5 Project, while at the same time looking beyond the flashy marketing materials and not simply taking the advice of the “salesman” who may be receiving a large commission for you investing into the EB5 Project.
