The regulations of the EB-5 Investor Visa program state that the investment must be “at risk”, however even with this being said, having a reasonable expectation that after the agreed upon investment period you will have your money returned to you.  This is undoubtedly one of the biggest concerns for almost all of our clients. 

As many Attorneys and EB-5 Consultants will tell you, the EB-5 Program is to be looked at as an Immigration Program first and as an investment opportunity second.  However this does not mean that you should simply throw caution to the wind or accept the advice of an inexperienced sales person when dealing with something as important as Permanent Residency for you and your family.

As mentioned above, there is no guarantee that the EB-5 Investor will get his/her investment funds back under the EB-5 Program. The United States Citizenship and Immigration Services (USCIS) always stress the fact that under the EB-5 Program, the foreign investors’ investment funds must be “at risk”.  There are some Regional Centers and EB-5 Projects that claim to have “third party guarantees” or “insurance policies” that can be purchased in order to eliminate the risk.  We strongly suggest that these claims of “guarantee” be reviewed in detail with an impartial advisor that does not work directly for the Regional Center.
