Do older EB5 Regional Centers get faster approvals than new Regional Centers?
This is a question that has been asked of us by several clients over the years, to this point we should look closely at the reasons why a prospective EB5 investor would wonder if there was truth to this statement.
Some EB5 Regional Centers have actually made the claim to investors that because they have had a number of successful I-526 approvals and have a history of approved I-829 approvals the new applications made into their Regional Center are given preferred treatment by USCIS and are expedited through the system. Our staff has specifically asked the Supervisors at United States Citizens and Immigration Services (USCIS) if there is any truth to this rumor and we were given an answer of “absolutely not”.
It is not acceptable to consider one Regional Center over another simply based on the amount of time the Center has been approved or even on the amount of I-526 or I-829 approvals. The prospective investor needs to remember that they are not investing into a Regional Center, but that they are investing into a specific project within that Regional Center and just because project #1 was successful this does not automatically guarantee that project #2 will be successful or that it should be considered “safe”.
