How to apply for an EB-5 visa
According to the U.S. Citizenship and Immigration Services (UCSIS), obtaining U.S. green card eligibility through the EB-5 visa program is a three-step process.
Through this program, foreign nationals can receive such eligibility by making an investment of $1 million (or $500,000 in some areas) in an American company or project that either creates or maintains at least 10 full-time jobs.
The first step in the application process requires the applicant to obtain approval for his or her Form I-526 Petition for an Alien Entrepreneur.
Next, according to the USCIS, the applicant is required to either file an I-485 application, which would make the person's status "lawful permanent resident," or apply for an immigrant visa at a consulate in the U.S. or an embassy outside of the country.
Finally, a Form I-829 Petition by an Entrepreneur to Remove Conditions needs to be filed 90 days before the two-year anniversary of the granting of the conditional green card to the applicant, according to the USCIS.
If this is approved by the agency, "the EB-5 applicant will be issued a new green card without any further conditions attached to it, and will be allowed to permanently live and work in the United States," according to the USCIS website.
