Is my Immigration Lawyer qualified to help me choose an EB-5 Regional Center?
The EB-5 Program can be overwhelming and with almost 150 designated EB-5 Regional Centers to choose from the process can become quite confusing when attempting to gather information on a Regional Center. Not to mention trying to decipher their offering documents and understanding some legal terms that may be unfamiliar to you. It is understandable that as a foreign investor you would be looking for an experienced immigration lawyer to assist you.
In most cases an immigration lawyer will not provide assistance in choosing a Regional Center. The immigration lawyer’s purpose is to focus on the legal aspect of the EB-5 visa.
The first rule of the American Bar Association (ABA) Model Roles of Professional Conduct (Model Rules) states:
A lawyer shall provide competent representation to a client. Competent representation requires the legal knowledge, skill, thoroughness and preparation reasonably necessary for the representation.
Unless your immigration lawyer has performed the due diligence and research necessary in helping you compare one Regional Center to another, they may not have not met the threshold of competent representation. Immigration lawyers are trained to assist their clients in the legal process of obtaining a visa rather than the business analysis of the EB-5 Regional Center and the projects being offered by the Regional Center. Before your immigration lawyer refers you to a particular Regional Center, he/she must know the business processes that will affect your investment and ultimately the approval of your green card.
There are many important factors that should be taken into consideration when it comes to choosing the best and safest Regional Center and Project for you and your family. The best and safest Regional Center for you is not necessarily the best and safest for another foreign investor. Every foreign investor has different investment requirements.
